WagwEU implementations

The Terms of Employment Posted Workers in the European Union Act (WagwEU) applies to employers from EU countries who will temporarily carry out work in the Netherlands with their staff. This act stipulates that employers are obliged to grant certain minimum terms of employment to the staff that will temporarily work in the Netherlands. The Inspectorate SZW will inspect this. In the course of spring 2020 the SVB (Sociale Verzekeringsbank) will implement an online tool so companies can notify their EU staff when temporarily working in the Netherlands  

Possible notification for non-EU temporary staff is already implemented through the UWV.

The company has the obligation to keep the following records onsite (in NL) of the posted workers: 

  • Employment agreement
  • Payslips
  • Hour registration
  • A1 certificate or alternative
  • Proof of salary payment
  • Contact person
  • Identification
